Elements of a Valid DMCA Notice
- A physical or electronic signature of the copyright owner or an authorized agent.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
- Identification of the material claimed to be infringing, including the specific URL on the Service and enough information for us to locate it.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
Incomplete notices may not result in action. Sending a false notice may expose you to damages under 17 U.S.C. § 512(f).
Counter-Notification
If your material was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notification containing:
- Your signature (physical or electronic).
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in the district where you reside (or for non-U.S. residents, Wilmington, Delaware), and that you will accept service of process from the person who submitted the original notice or their agent.
Repeat-Infringer Policy
We terminate the accounts of users who we determine are repeat infringers. Receiving three (3) valid DMCA notices is grounds for termination. We may also terminate accounts for a single egregious infringement.
