User Agreement & Content Policy
This is a passive marketplace. You are solely responsible for complying with all federal, state, and local laws in connection with any listing, purchase, sale, shipment, installation, or use of any vehicle or part.
1. Prohibited Listings and Content
You may not list, offer, solicit, or advertise:
- Stolen vehicles, stolen parts, or any item with altered or removed Vehicle Identification Numbers (VINs). Trafficking in vehicles or parts with altered VINs is a federal crime under 18 U.S.C. § 2321.
- Airbags, inflators, or Supplemental Restraint System (SRS) components where resale is restricted or prohibited by state law (including but not limited to California Vehicle Code § 27317). Seller bears the full burden of legal compliance.
- Catalytic converters lacking documented chain of custody or proof-of-ownership, or in violation of state stolen-parts statutes.
- Emissions-defeat devices in violation of the Clean Air Act 42 U.S.C. § 7522 or CARB regulations. Sale “for off-road use only” does not shield the seller from liability.
- Counterfeit branded parts or parts falsely labeled as original equipment (OE/OEM).
- Parts subject to an open, unresolved NHTSA safety recall.
- Firearms, ammunition, explosives, hazardous materials (except lawfully shipped automotive batteries), drugs, animals, human remains, sexually explicit material, or anything illegal in the jurisdiction of either buyer or seller.
- Services, non-automotive items, rentals, financing, or off-platform links used to circumvent the marketplace or our policies.
- Content that harasses, threatens, defames, impersonates, or invades privacy; content that infringes copyright, trademark, trade secret, or publicity rights.
- Spam, bulk listings, keyword stuffing, fake listings, or market-manipulation.
2. Seller Obligations
- Accurate listings. Honestly describe title status (Clean / Salvage / Rebuilt / Junk), mileage, damage history, part condition, and any material defect.
- Legal right to sell. You must hold title to any vehicle or part listed, or be authorized in writing by the titleholder.
- Odometer disclosure. Federal law (49 CFR § 580) may require written odometer disclosure on vehicle transfer.
- Title branding. Disclose salvage, rebuilt, flood, fire, lemon-law buyback, or other branded-title status. Many states require a specific written disclosure.
- Photos. Photos must depict the actual item listed. Stock photos must be clearly labeled.
- Transactions off-platform. All payments, transport, installation, and title transfer occur between you and the buyer, off BustnFound, at your risk.
3. Buyer Obligations
- Inspect before purchase. Inspect the vehicle or part in person or through a qualified agent. Verify VIN, condition, mileage, and title status before paying.
- Verify title and registration. Confirm the seller has clear title and that you can lawfully register, title, and operate the vehicle in your state. Some branded titles cannot be re-registered in some states.
- Research local law. Emissions, smog, safety inspection, salvage-rebuild, and parts-resale rules vary widely. You are responsible for compliance in your jurisdiction.
- Transport and installation. Arrange transport, installation, and any required certification at your own cost and risk.
4. Enforcement
BustnFound has no obligation to monitor, screen, verify, or inspect listings, users, or transactions. We may, at our sole discretion and without notice, remove listings, suspend accounts, and report suspected illegal activity to law enforcement. We are not liable for removing or failing to remove any listing or account.
5. Your Acknowledgments
By using the Service you acknowledge and agree that:
- BustnFound is not a party to any transaction. We do not take title, custody, or possession of any vehicle or part at any time.
- We do not verify user identity, title documents, VINs, mileage, recalls, legal right to sell, or the condition of any listed item.
- All risk of loss, fraud, misrepresentation, personal injury, or property damage arising from any transaction is borne by the users directly transacting.
- You release BustnFound from any claim related to another user, another user’s content, or any transaction, to the maximum extent permitted by law, including claims you do not yet know or suspect to exist (and you waive any protection of California Civil Code § 1542 and similar provisions).
